Welcome to LookBeforeYouMove ("LBYM", "we", "us", or "our"). By accessing or using our website at lookbeforeyoumove.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age and that all information you provide is accurate and complete.
The Service offers three types of accounts:
By creating a Consumer account, you consent to receive communications from LBYM and its third-party partners, including but not limited to real estate agents, mortgage lenders, moving companies, home inspectors, and cleaning services. Your contact information (email address and phone number) may be shared with partners matched to your search areas for marketing purposes.
Marketing consent is required to maintain a Consumer account on LBYM. The only way to fully opt out of third-party communications is to delete your account through the Settings page. Deleting your account will permanently remove all your data, including saved areas, Life List criteria, and any reports.
When you interact with the Service — including saving areas, clicking on sponsored ads, or engaging with Local Connections — your name, email, and/or phone number may be shared with relevant agents and businesses as a "lead." The level of contact information shared depends on your interaction:
Agent and Business accounts are billed monthly on a per-zip-code or per-coverage-area basis. Rates are determined at the time of purchase and may vary based on position (for agents) and coverage radius (for businesses). "Founding" rates are locked in for accounts that enable auto-renew and are not subject to future price increases.
Subscriptions renew automatically each month. You may disable auto-renew at any time through your portal. Disabling auto-renew means your zip code or coverage area will become available to other agents or businesses at the end of the current billing period.
Zip codes have a limited number of agent slots (typically 1-3, set at our discretion). When all slots are filled, additional agents may join a waitlist. LBYM reserves the right to adjust the maximum number of agents per zip code at any time.
LBYM does not guarantee any specific number of leads, views, or conversions. Lead volume depends on consumer activity in your claimed areas and is not warranted or promised.
You retain ownership of content you upload (logos, headshots, ad copy). By uploading, you grant LBYM a non-exclusive, royalty-free license to display your content within the Service for the purpose of delivering your ads to consumers.
You agree not to: (a) use the Service for any unlawful purpose; (b) upload false, misleading, or deceptive content; (c) attempt to access other users' accounts or data; (d) scrape, crawl, or systematically extract data from the Service; (e) interfere with the operation of the Service.
Neighborhood data displayed on LBYM, including points of interest, distances, school ratings, crime statistics, and cost-of-living estimates, is sourced from publicly available records and third-party data providers. While we strive for accuracy, LBYM does not guarantee the completeness, accuracy, or timeliness of any data. You should independently verify all information before making relocation decisions.
All payments are processed through Stripe. By providing payment information, you authorize LBYM to charge your payment method on a recurring monthly basis. You are responsible for all charges incurred under your account. Refunds are handled on a case-by-case basis at our discretion.
We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. You may delete your Consumer account at any time through Settings. Agent and Business accounts may be canceled through their respective portals, subject to the end of the current billing period.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LBYM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO LBYM IN THE 12 MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LBYM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You agree to indemnify and hold harmless LBYM and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or in-app notification.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Travis County, Texas.
